For the charge of possession of child pornography, the crime is a Class 1 Felony. The punishment for a Class 1 Felony in Illinois is between 4 and 15 years in prison with the option of an extended sentence of 15 to 40 years in prison.
A fine of between $1,500 and not more than $100,000 may also be applied during sentencing.
Dissemination of child pornography can be one of two charges. The first is a Class X felony and covers all video and move picture media. A Class X felony in the state of Illinois is punishable by between 6 and 30 years in prison with an extended sentence possible of between 30 and 60 years. A fine of between $1,500 and $100,000 can be applied.
All other types of child pornography are considered Class 1 felony crimes and are subject to the same penalties as possession charges.
For anyone convicted of possession or dissemination of child pornography, the person will be required to register with the state as a sex offender.
